1. Eligibility & Use
   You must be able to enter into binding agreements and use the Service in compliance with all applicable laws and regulations, including export controls and sanctions.
2. Your Files & Ownership
   You retain all intellectual property rights in the designs you upload. By submitting files, you grant IDMockup a limited, non-exclusive license to store, process, analyze, manufacture, and deliver the parts and services you request, and to provide support and quality assurance.
3. Confidentiality & Data Handling
   We treat uploaded files as confidential and restrict access to personnel and vetted subprocessors who need it to fulfill your request. Files are stored encrypted at rest and in transit where technically feasible. Unless you expressly authorize otherwise (e.g., by written consent or NDA), we do not publish or share your designs with third parties beyond what is needed to provide the Service.
4. Prohibited Content & Uses
   You agree not to upload or request manufacturing of:
   • Content you do not have the right to use or that infringes third-party IP.
   • Items restricted under export control/sanctions (e.g., military, dual-use without authorization), illegal devices, or unsafe products.
   • Content that includes malware or attempts to disrupt our systems.
   • Sensitive personal data or medical devices requiring regulatory approvals unless you have obtained all necessary authorizations and provide documented requirements.
5. Accuracy, Pricing & Orders
   Instant quotes are non-binding estimates. Final pricing, specifications, and lead time are confirmed in an Order Confirmation or Commercial Invoice after engineering review. We may correct errors, update pricing (e.g., due to material or exchange-rate changes), or decline orders. Tolerances not explicitly stated in your drawings/notes will default to our standard manufacturing tolerances. The quotes do not include any surface finishes or colors by default.
6. Tolerances, Finishes & Materials
   Unless otherwise agreed in writing, CMF standards and grain/texture are “commercially reasonable” best efforts. Material substitutions of equivalent performance may be proposed if primary stock is unavailable. You are responsible for validating that the chosen material/finish is fit for your intended use.
7. Taxes, Duties & Shipping
   Prices are typically EXW/FOB (as specified). Taxes, duties, customs fees, insurance, and special freight are your responsibility unless otherwise agreed. Risk of loss passes per the stated Incoterms.
8. Lead Times & Changes
   Quoted lead times are estimates based on current capacity and may change due to DFM revisions, supply constraints, or force majeure events. Design changes after order placement may affect price and schedule.
9. Warranties & Liability
   THE SERVICE IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, IDM0CKUP DISCLAIMS ALL WARRANTIES (EXPRESS, IMPLIED, OR STATUTORY), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IDM0CKUP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, COVER, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOSS OF USE, OR LOSS OF DATA. IDM0CKUP’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE OR AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE AFFECTED ORDER.
10. Indemnification
    You agree to indemnify and hold IDMockup harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your uploads, instructions, or misuse of the Service, including alleged IP infringement or regulatory violations related to your designs.
11. Export Controls & Sanctions
    You represent that you and the ultimate end-users are not located in, and will not ship to, embargoed or sanctioned countries or restricted parties, and that your designs are not subject to export restrictions without proper authorization. You agree to provide classification information upon request.
12. Service Changes
    We may modify or discontinue the Service, or update these Terms, at any time. Material changes will be noted on this page with an updated “Last Updated” date.
13. Governing Law & Disputes
    These Terms are governed by the laws of Taiwan (R.O.C.), without regard to conflict-of-law rules. The parties agree to the exclusive jurisdiction of the courts located in Taipei, Taiwan (or another forum mutually agreed in writing).
